Overview
Notice of Proposed Lease of Common Good Property: Area of Ground within Hunter’s Hall Public Park, Edinburgh
Under section 104 of the Community Empowerment (Scotland) Act 2015, the local authority is required to publish details of any proposed disposal or change of use in respect of property held as part of the Common Good register and invite representations from community councils, community bodies and any other persons.
The City of Edinburgh Council is to dispose of, by lease, and change the use of an area of ground which forms part of its Common Good property as follows:
Background
Airwave Solutions Limited (Airwave) is an electronic communications code operator providing the telecommunications network for the emergency services in the UK. This essential public service is required to be fully operational at all times.
Due to upcoming redevelopment of the site where an existing Airwave signalling tower is located, Airwave has been required to find an immediate alternative location to install a new tower so that there is no drop in their network coverage.
Proposal
Airwave has identified Hunter’s Hall Public Park as the preferred option to install and operate a new telecommunications signalling tower, with ancillary ground-based equipment.
Airwave has served a statutory notice to the City of Edinburgh Council in accordance with Paragraph 20(2) of Part 4 of Schedule 3A of the Communications Act 2003, seeking the Council’s agreement to confer on Airwave the necessary rights for the purpose(s) outlined above. Rights would be conferred by entering into a lease with Airwave.
The area of ground proposed to be leased is approx. 8m x 8m, located close to the tree belt on the periphery of the park.
